THE RISE IN PRICE OF MATERIALS DOES NOT REMAIN WITHOUT ATTENTION OF THE AUTHORITIES

The Ministry of Economy of Ukraine is developing an update of procurement legislation due to changes in prices for materials.

During 2022, the main construction materials and, accordingly, road construction works have significantly increased in price. As of August 2022, the cost of road construction works has grown by 40% compared to November 2021. 

At the same time, the procurement legislation still does not allow the parties to the contract to change the cost of works and the price of the contract with their consent, even in case of a justified need such as the current urgent situation. 

The Ukrainian Infrastructure Association several times appealed to the main regulator of public procurement with the initiative to increase the list of cases in which the law allows to change the essential terms of the contract. 

In its latest response, the Ministry of Economy of Ukraine assures that the initiative is in the work process. The responsible body is developing changes together with the involvement of competent specialists and provides in the letter the working wording of the draft law.
