Initiative to return performance guarantees

The companies’ assets have been blocked by banks as collateral for performance guarantees under contractor agreements. In other words, contractors bear the cost of guarantees to ensure the performance of contracts that cannot be started due to Russia’s military aggression. At the same time, it is impossible to return the guarantees for the period of martial law due to restrictions on changes to the essential terms of the procurement contract.

The Association addressed the Parliament with proposals to amend the Law of Ukraine “On Public Procurement” to resolve the issue.
