Draft Law 9027 enables controlled review of contract prices
The Association addressed the Verkhovna Rada Committee on Economic Development with a letter in support of the draft law on the possibility of changing the terms of the procurement contract.
UNITE has repeatedly stressed the problem of the impossibility to amend the contract in the face of rising prices for materials and the need for appropriate legislative changes. The idea was supported by government agencies and NGOs.
The Law of Ukraine “On Public Procurement” in Article 41 contains several cases in which the terms of the procurement contract may be changed. All of them can be applied to any contract. For example, the provision on changing the contract price due to changes in the exchange rate (clause seven of part five of Article 41) does not contain any restrictions or safeguards.
However, during martial law, budget expenditures are even more carefully calculated than in peacetime. That is why the draft law No. 9027 provides for limited use of the grounds for price changes in a limited number of contracts. This is a prerequisite for the rapid restoration of infrastructure. Valuable time should be used to perform construction and repair work, not to go through bureaucratic procedures again.
Unfortunately, on March 20, the draft law was returned for revision. We emphasize its importance and ask the Verkhovna Rada to finalize it as soon as possible and adopt it as a whole.
